1. Acceptance of Terms

By creating an account or using Famli, you agree to these Terms of Service. If you do not agree, do not use the service. Famli reserves the right to update these terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

Famli is an AI-powered family history knowledge base. You can upload documents, photos, letters, audio recordings, and notes. Famli processes them with AI to create a searchable, structured archive with AI-powered chat, knowledge graphs, and family trees.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 13 years old to use Famli.

You may delete your account at any time from the Account settings. Account deletion is permanent and irreversible. See our Privacy Policy for details on data deletion.

4. Your Content

Ownership: You retain full ownership of all content you upload to Famli, including documents, photos, letters, audio recordings, and notes. Famli does not claim any ownership rights over your content.

License: By uploading content, you grant Famli a limited, non-exclusive license to store, process, and display your content as necessary to provide the service. This includes processing by AI models for text extraction, entity recognition, and knowledge generation.

Responsibility: You are responsible for ensuring you have the right to upload and share content. Do not upload content that infringes on others' intellectual property rights, is illegal, or violates these terms.

5. AI-Generated Content

Famli uses AI (Google Gemini) to extract information, identify people, generate summaries, and answer questions about your archive. AI-generated content may contain errors, inaccuracies, or hallucinations. You should verify important information independently.

AI outputs are provided "as is" without warranty of accuracy. Famli provides confidence indicators and source citations to help you evaluate AI-generated information, but you should not rely on AI outputs for legal, medical, or other critical decisions.

6. Acceptable Use

You agree not to:

  • Use Famli for any unlawful purpose
  • Upload malicious files, viruses, or harmful content
  • Attempt to access other users' data or family archives
  • Circumvent usage limits, billing controls, or security measures
  • Use automated tools to scrape or bulk-access the service
  • Resell or redistribute the service without authorization

7. Billing and Subscriptions

Famli offers free and paid plans. Paid subscriptions are billed monthly or yearly through Stripe (web) or through the Apple App Store (iOS). You can manage your subscription through the billing portal (web) or through your Apple ID subscription settings (iOS).

Subscription tiers: Basic, Family, and Legacy plans are available with monthly or yearly billing. Each tier includes specific limits on documents, storage, and family members. Full pricing and plan details are available on the Plans screen within the app and on the Famli website.

Auto-renewal: Paid subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. You may cancel at any time through the billing portal (web) or your Apple ID subscription settings (iOS).

Plan limits (documents, storage, members) are enforced at the time of use. If you downgrade your plan, existing content above the new limits will be preserved but you will not be able to add new content until usage is within limits.

Refunds are handled on a case-by-case basis. For App Store purchases, refund requests are handled by Apple in accordance with their refund policies. For web purchases, contact us for refund requests.

8. Family Collaboration

Family archive owners can invite others to join their archive. All members share access to the full archive. The archive owner is responsible for managing membership and content within their archive.

By joining a family archive, you agree that other members can view content you add. The family owner may remove members at any time.

9. Service Availability

Famli strives for high availability but does not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify users of planned downtime.

10. Limitation of Liability

To the maximum extent permitted by law, Famli and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the service.

Famli's total liability for any claim arising from these terms shall not exceed the amount you paid for the service in the twelve months preceding the claim.

11. Termination

Famli may suspend or terminate your account if you violate these terms. You may terminate your account at any time by deleting it from the Account settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.

13. Apple App Store Additional Terms

The following additional terms apply when you download or use the Famli mobile application ("Licensed Application") through the Apple App Store. These terms are required by Apple and supplement the terms above.

Acknowledgement: You acknowledge that these Terms of Service are between you and Famli only, and not with Apple Inc. ("Apple"). Famli, not Apple, is solely responsible for the Licensed Application and its content. These terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

Scope of License: The license granted to you for the Licensed Application is a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed by other accounts associated with you via Family Sharing or volume purchasing.

Maintenance and Support: Famli is solely responsible for providing maintenance and support services for the Licensed Application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

Warranty: Famli is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Famli's sole responsibility.

Product Claims: You acknowledge that Famli, not Apple, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property: You acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Famli, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms: You agree to comply with all applicable third-party terms of agreement when using the Licensed Application, including your wireless data service agreement and any other relevant service agreements.

Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms of Service. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary thereof.
